GROUP HOUSING

 

Pre-requisites

 

             For any agency to consider the application for construction / development of group housing, the following requirements must be fulfilled.

 

1)      If the site (land) proposed for Group Housing purposes is agricultural land, the land must have been converted to non-agricultural purpose by the concerned revenue authority. Refer to the topic on conversion of land from agricultural to non-agricultural purposes (Annexure-III).

 

2)      If the site is situated in a local planning area for which a Master Plan has been prepared and approved by the Government, the land proposed for development purpose must have been zoned for residential use in the Master Plan.

 

3)      If the land is not zoned for residential use in the Master Plan, the owner / applicant has to apply to the concerned authority for change of use of the land u/s 14-A of the Karnataka Town and Country Planning Act, 1961 from the one proposed in the Master Plan to residential use.

 

4)      Clearances from:

 

a)     Airport Authority of India in Bangalore and other places where airport or airstrips exist regarding the height of buildings permissible.

 

b)     BWSSB in Bangalore to provide water supply and underground drainage system.

 

c)      KUWS&DB in other places to provide water supply and underground drainage system.

 

d)     Concerned Electricity Supply Company to provide electricity supply.

 

e)     Fire Force regarding measures required for safety against fire.

 

f)        No-Objection Certificate from Karnataka State Pollution Control Board.

 

 

Application

 

             The owner or the legal entity of the land, which has been converted, from agriculture to non-agriculture purpose has to make an application, on plain paper, to one of the following; 

 

1)     To the Bangalore Metropolitan Region Development Authority (BMRDA) (jurisdiction including Bangalore Urban, Bangalore Rural districts and excluding the areas coming within the jurisdiction of local planning area i.e. BDA limits), and the application has to be addressed to the Metropolitan Commissioner, BMRDA, LRDE Building, Ali Askar Road, Opposite Palace Hotel, Bangalore- 560 052.

 

For other Local Planning Areas with in the BMRDA, the following Planning Authorities are to be contacted

 

Member Secretary of the Planning Authority, Magadi, Nelamangala, Kanakapura and Bangalore International Airport Planning Authority (BIAPA) and Bangalore-Mysore Infrastructure Corridor Area Planning Authority (BMICAPA).

2)     To the Bangalore Development Authority (BDA), if the land is situated within the jurisdiction of BDA, the application has to be addressed to the Commissioner, BDA, T. Chowdaiah Road, Kumara Park West, Bangalore 560020.

 

3)     To the Urban Development Authority (UDA), if the land is situated within the jurisdiction of the concerned UDA. There are 27 UDAs in the State. The application has to be addressed to the Commissioner of the concerned Development Authority.

4)     To the Planning Authority (PA), if the land is situated within the jurisdiction of the concerned Planning Authority. There are 24 planning authorities in the State.  The application has to be addressed to the Member-Secretary of the concerned planning authority.

 

5)     To the Municipal Planning Authority (MPA), if the land is situated within the jurisdiction of the concerned municipal planning authority. There are 45 MPAs in the State. The application has to be addressed to the concerned municipal planning authority.

 

6) Outside the jurisdiction of the local planning areas, to the concerned local authority, which in turn takes technical approval from the concerned Asst. Director of Town Planning. As per delegation of powers, the Assistant Director of Town Planning of the respective districts is delegated with the power up to 1.5 hectares; Joint Director of Town Planning is delegated with the power up to 4.0 hectares and Director of Town Planning full power.

 

 

Details to be furnished with the application

 

             The following details are to be furnished by the applicant with the application to the concerned authority for issue of planning clearance.

 

      1)             Photocopy of the title deed to establish the proof of ownership of the land.

(originals to be shown for verification).

 

      2)             Photocopy of the order from the concerned revenue authority for having converted the land from agriculture to non-agricultural purpose.

 

      3)             Photocopy of the possession certificate.

 

      4)             Original Atlas (P.T. sheet) of the land (survey number) duly issued by the Department of Survey Settlement and Land Records, showing the dimensions in meters and boundary of the land proposed for development.

 

      5)             Photocopy of the revenue survey map of the village showing the location of the land proposed.

 

      6)             Site plan drawn to scale 1:200 showing the details on cadastral boundaries of all the survey numbers and hissas included in the scheme, access from nearby public road, contours, spot heights, the developments in the surrounding areas of the proposed land including approach road, with width, power transmission line, telephone line, railway line, nearby water reservoirs, nalas, etc.

 

Outline of the block(s) of building(s) proposed to be constructed, setback space from the building(s) to the property, driveways, parking of vehicles within the building and outside, stair-cases, water sump, and electricity sub-stations, disposal of sewage.

 

Plinth area of each building, area of each floor in the building, total floor area of each building and of all the buildings in sq.mts. Floor Area Ratio (FAR), number of car parking spaces provided as per the provisions of Zoning Regulations.

      7)             Drawing of buildings (plans, sections and elevation of buildings) in triplicate, drawn at not smaller than scale 1:100 showing plan of all the floors in all the buildings, roof plans of all the buildings, common areas, lifts, staircases, escalators, if any, emergency exits, cross-sections, especially along the stairs of all stair cases, elevations of all the sides, etc.

 

      8)             Other details as prescribed in the zonal regulations / building byelaws.

 

Procedure for approval of group housing plan

 

      1)             On examination of the document, additional clarification, if any, required, the applicant must furnish the required information or document to the authority.

 

      2)             In case the site plan and / or the drawings for the building(s) need revision or modifications, the applicant shall comply with such revision or modifications.

 

      3)             On being satisfied that the site plan and / or the drawings for the building(s) can be approved, subject to such conditions, the applicant will be informed by the authority to pay the fee, charges prescribed by Bangalore Development Authority/UDA/PA/MPA as the case may be.

 

      4)             On payment of the prescribed charges to the prescribed authority, the drawings for the site and the building(s) will be approved subject to such conditions as may be specified and the same will be released to the applicant.
