ಕರ್ನಾಟಕ ಸರ್ಕಾರದ ನಡೆವಳಿಗಳು
ವಿಷಯ: ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳನ್ನು ರಚಿಸುವಾಗಿ ಅನುಸರಿಸಬೇಕಾದ ವಿಧಾನದ ಬಗ್ಗೆ.

ಪ್ರಸ್ತಾವನೆ:
ಮೇಲೆ (1) ರಲ್ಲಿ ಓದಲಾದ ಸರ್ಕಾರಿ ಆದೇಶದಲ್ಲಿ ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳನ್ನು ರೂಪಿಸುವಾಗಿ ವಿಧಾನವನ್ನು ವಿವರಿಸಲಾಗಿದೆ.  ಅದರಕ್ಕು ವೃಂದ ಪರಿಶೀಲನಾ ಉಪ ಸಮಿತಿಯ ತೀರ್ಮಾನದ ಆಧಾರದ ಮೇಲೆ ನಿಯಮವನ್ನು ರಚಿಸಿ ತದನಂತರ ಅದನ್ನು ವೃಂದ ಪರಿಶೀಲನಾ ಸಮಿತಿಯ ಮುಂದೆ ಮಂಡಿಸಬೇಕೆಂದು ಹೇಳಲಾಗಿದೆ.  ಆದರೆ ವೃಂದ ಪರಿಶೀಲನಾ ಸಮಿತಿಯ ಮುಂದೆ ಪ್ರಸ್ತಾವಗಳನ್ನು ಮಂಡಿಸುವ ಮೊದಲು ಇನ್ನಷ್ಟು ಕ್ರಮ ಕೈಗೊಳ್ಳುವ ಅಗತ್ಯವಿದೆಯೆಂದು ಕಂಡುಬಂದಿದೆ.  ಆದ್ದರಿಂದ ಈ ಆದೇಶ.

ದಿನಾಂಕ 08.10.2004ರ ಆದೇಶದ ಪ್ಯಾರಾ 5-6ರಲ್ಲಿ ನಿಗಧಿಪಡಿಸಿದ ವಿಧಾನದಂತೆ ವೃಂದ ಪರಿಶೀಲನಾ ಉಪ ಸಮಿತಿಯು ವೃಂದ ಮತ್ತು ನೇಮಕಾತಿ ನಿಯಮಗಳ ರಚನೆ/ತಿದ್ದುಪಡಿ ಪ್ರಸ್ತಾವಗಳನ್ನು ಪರಿಶೀಲಿಸಬೇಕು.  ಹೀಗೆ ಪರಿಶೀಲಿಸಿದ ನಂತರ ತೆಗೆದುಕೊಳ್ಳುವ ತೀರ್ಮಾನದಂತೆ ಕರಡು ನಿಯಮಗಳನ್ನು ಆಡಳಿತ ಇಲಾಖೆಯು ರಚಿಸಿ ಅವುಗಳನ್ನು ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನಾ ಇಲಾಖೆಯಿಂದ ಪರಿಶೋಧಿಸಿಕೊಳ್ಳಬೇಕು.  ವೃಂದ ಪರಿಶೀಲನಾ ಸಮಿತಿಯ ಮುಂದೆ ಪ್ರಸ್ತಾವವನ್ನು ಮಂಡಿಸುವಾಗಿ ಅದರೊಂದಿಗೆ ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನಾ ಇಲಾಖೆಯು ಪರಿಶೋಧಿಸಿದ ಕರಡನ್ನು ಮಂಡಿಸಬೇಕೆಂದು ಈ ಮೂಲಕ ಆದೇಶಿಸಿದೆ.

Preamble: A Cadre Review Committee was constituted under the Chairmanship of Additional Chief Secretary in Government Order No. DPAR 97 SRD 2004 dated 08.10.2004 consisting of following officers:

Additional Chief Secretary

Principal Secretary/Secretary to Government
Finance Department
Head of the Department concerned.

To facilitate a comprehensive review of the proposals for amendments to Cadre and Recruitment Rules/Special Rules, to be placed before the Committee, it has been considered necessary to reconstitute this Committee.

Government Order No. DPAR 82 SRD 2006, Bangalore dated 08.05.2007

For the reasons stated in the preamble, the Cadre Review Committee under the Chairmanship of Additional Chief Secretary constituted in Government Order No. DPAR 97 SRD 2004, dated 08.10.2004 is constituted with immediate effect.  The Committee will cosnist of the following officers:-

Principal Secretary/Secretary to Government, Finance Department
Representative of Law, Justice and Human Rights, Department.

Sub : Cadre and Recruitment Rules – Review of
Read: O.M. No. DPAR 59 SRD 2002 dated 23-09-2002.
Preamble
In the OM read above, a procedure for reviewing the Cadre and Recruitment Rules has been laid down.  It is found that this procedure requires to be modified.  Hence this order.
GOVERNMENT ORDER NO. DPAR 97 SRD 2004, Bangalore, dated 08.10.2014
In supersession of the OM read above, the following instructions are issued in the matter:
1. The framing/review of the Cadre and Recruitment Rules of various departments shall be done by a Cadre Review Committee consisting of the following:

1. Additional Chief Secretary to Government
2. Principal Secretary/Secretary to Government of the Administrative Department concerned.
3. Principal Secretary/Secretary to Government, Finance Department.
4. Head of the Department concerned.

2. The Cadre Review Committee shall ensure that Cadre and Recruitment Rules are framed expeditiously in respect of such of the departments which do not have C & R Rules at present.  It shall also ensure that the existing Cadre and Recruitment Rules are reviewed at least once in three years.

3. While reviewing the Cadre and Recruitment Rules the following points may be kept in view:-
(I) Whether the qualifications already prescribed in the existing rules, recruitment should be modified and updated in view of the new Degrees, Diplomas and Certificates being awarded by the educational institutions.
(II) Whether the manpower requirement of the department is adequately met by the existing (sanctioned) posts in keeping with the normal growth pattern and the implementation of various developmental plans and programmes.
(III) Whether there is scope to reduce the number of posts;
(IV) Whether the existing quota of direct recruitment ensures adequate infusion of fresh blood in the cadres concerned and whether direct recruitment is taking place regularly;
(V) Whether there is stagnation of over ten years without promotion in any cadre and if so any adjustments are possible to minimise such stagnation; and
(VI) Whether there is need to encadre as deputation reserve posts, posts in other departments/autonomous bodies.
(VII) The action taken on the orders regarding the abolition of 80% of the vacant posts existing as as on 1st April 2000 should be suitably incorporated.

The process of review of the Cadre and Recruitment Rules should be initiated by the Heads of Departments.  They should make a detailed study of the requirements of the Department and formulate the proposals after scrutiny by a Departmental Committee, consisting of the following:
[a] Head of Department
[b] Two members from the cadre of Additional/Joint/Seputy Heads of Department nominated by Head of Department.
The two members from the category of Addl/Joint/Deputy Heads of Department should be drawn from the State Civil Service cadres of the department.  Officers working in the department on deputation from any other department or service should not be nominated.  Before finalising its proposals, the Committee should not be nominated.  Before finalising its proposals, the Committee should normally discuss with the representatives of the departmental employees associations.  The proposals thus finalised should be sent in ten sets by the Head of the Department to the Administrative Department of Secretariat with all the details in the Forms I to IX enclosed to this G.O.  The Department may also furnish any other relevant details in a separate statement to explain the special problems of his department in support of his proposals.  A consolidated proposal should be sent in respect of all cadres, i.e., all the posts in Group A, B, C and D.

4. The Administrative Department of Secretariat should scrutinise the proposal and send with its views, one set of proposals each to Department of Parliamentary Affairs and Legislation, Finance Department and DPAR (Service Rules) simultaneously for comments/concurrence.  The consulting departments should examine the proposals and communicate their views to the administrative department within one month.  The Secretary in the administrative department should; on receipt of the comments of the Department of Parliamentary Affairs and Legislation, Finance Department and the DPAR (Service Rules) place the matter for consideration in detail in a meeting of a Sub-Committee of the Cadre Review Committee consisting of the following:

[1] Principal Secretary / Secretary to Government of the Administrative Department
[2] Head of Department
[3] Representatives of Departments of Finance, DPAR (Service Rules) and Department of Parliamentary Affairs and Legislation.

Details proceedings will be drawn up indicating agreed proposals as also the differing view of any of the representatives of consulting departments.

5. The Administrative Department shall circulate thereafter the draft of the cadre and recruitment rules which it proposes to adopt, for consideration by the Cadre Review Committee.  In doing so, the differing views if any, of the representatives of the Consulting Departments in the Sub-Committee should also be circulated at least two weeks in advance.  Copies of all the material circulated to the members of the Cadre Review Committee should also be endorsed simultaneously to be concerned consulting Departments for information.

6. The Cadre Review Committee shall consider the drafts of the Cadre and Recruitment Rules in a meeting and finalise the proposals.  The proposals accepted by the Cadre Review Committee shall be deemed to have received the assent of the Finance Department.  The draft Cadre and Recruitment Rules as approved by the Cadre Review Committee should be got scrutinised from the Department of Parliamentary Affairs and Legislation.  The administrative department should obtain the approval of Cabinet for the draft Rules and thereafter publish the draft Rules in the official Gazette.

7. In case of objections, suggestions are received and the administrative department proposes to accept them and modify the draft rules accordingly, it should seek clearance of Cadre Review Committee and thereafter it should take action publish the draft rules as final rules.
